I am sure a lot of you guys want to change your job and changed also but got stuck or get stuck in a lot of problems. The reason you get stuck or got stuck could be because you have not completed one year of service, there is a clause related to non-competition in your agreement, a penalty clause in the Agreement etc. Today I will explain you the process related to resigning after completing one year with your employer.
.
Last week I had a chance to meet a very lovely and highly qualified couple and we discussed their problem. They have almost followed everything as per the law which includes resigning as per the contract, serving notice of termination and in my opinion they have even completed one year of service but now when they want to change the job the employer is asking them to waive their claim and then he will let them change the job otherwise they cannot.
.
They went to LMRA and LMRA said even though you have completed one year of service but as per our rules, we cannot allow mobility to you before you complete one year as per the dates are given in your visa/residence permit.
.
So what does it mean? I will explain this with an example. Let's suppose A lives in Bahrain and during his grace period of one month he joined B on 1st of January 2019 and the visa stamp was done in his passport on 30 January 2019 and it is from 30 January 2019 till 29 January 2020. So when he is completing one year of service? .
In my opinion and I am sure many of you will think it should be calculated from 1st January 2019 and finished on 31st December 2019. However, LMRA calculates the period from the day of the visa or the dates mentioned on RP in the passport. So they will calculate it from 29 January 2020.
.
So if anyone of you is contemplating to resign then you must consider this issue and please share your experiences as well in the comment box to help others.
Finishing my contract - Employer wants me to leave Bahrain
#laborlaw_kkblog
One of the followers recently messaged me that he is going to finish his employment contract and want to change the job but the employer wants him to leave Bahrain and what he can do.
I believe the employer either dont want him to work with someone else or as some people do when the employee leave from Bahrain they would file a case and get him blacklisted.
So, in these circumstances what he could do is to give a resignation in writing as per the employment contract mentioning the last working day and write also that visa is expiring this date or he could cancel his visa etc and he intends to stay and find another job etc whatever is best for him.
Also, as far as I know, the employer cannot force an employee to leave Bahrain even after the expiration of the work contract or work visa.
The government in Bahrain give one month grace period to all the expats to find a job and when the government is not asking anyone to exit means the employer can also not force the employee to leave Bahrain on expiry of the work contract.
Please share with your friends as well.
