Features of the L-1 and E visas
The L-1 and E visas are both non-immigrant visas that provide temporary residence for foreign nationals. However, there are differences that set the two categories of visas apart.
The L-1 visa
The L-1 visa is ordinarily available to companies that wish to transfer their employees to an affiliate or their parent company in the US. There are two types of L-1 visas: The L-1A and L-1B visas. The L-1A is available to employees in managerial or executive positions while the L-1B is available for employees with specialized knowledge about the company.
Qualifications
There are two key requirements that must be satisfied for the L-1 visa. The first is that the employee sought to be transferred must work as a manager, executive or position that requires specialized knowledge about the company’s processes and procedures.
The second is that the employee must have worked in the company for at least 1 year out of the 3 years preceding the L-1 visa application.
Time of stay
The period of stay of L-1 visas depends on which type is applied for. Once approved, the L-1A visa can entitle the manager or executive to stay in the US for up to 7 years in total.
Employees with specialized knowledge that have their L-1B visa approved can stay in the US for up to 5 years. It is initially approved for 3 years and a 2-year extension can be sought afterwards.
