Landmark report from UK Environmental Audit committee is out today: FIXING FASHION Congratulations to Mary Creagh MP and her colleagues. This group of lawmakers recommends fashion companies should receive tax incentives to produce environmentally friendly garments - and penalties if they don't! It starts: "The way we make, use and throwaway our clothes is unsustainable. Textile production contributes more to climate change than international aviation and shipping combined, consumes lake-sized volumes of fresh water and creates chemical and plastic pollution." "Fashion shouldn’t cost the earth. But the fashion industry has marked its own homework for too long. Voluntary corporate social responsibility initiatives have failed significantly to improve pay and working conditions or reduce waste." "The scientific warnings are stark on sustainability. Overconsumption and climate change are driving mass extinction. We need a new economic model for fashion. Business as usual no longer works. The Government should change the law to require companies to perform due diligence checks across their supply chains." The government now has two months to respond to The committee's recommendations. СХЕМА: кредитная многоходовка - компания берёт валютный кредит у банка, чтобы погасить кредит связанной компании перед тем же банком (дополнительное соглашение к соглашению об открытии мультивалютной кредитной линии), далее берёт валютный займ у материнской компании, чтобы погасить свой кредит перед банком и учитывает проценты и курсовые разницы по привлеченному займу для погашения кредита в составе внереализационных расходов. Результат ➡️ существенное снижение налоговой нагрузки по налогу на прибыль. . ⛔️ Но схема не сработала. При проведении выездной проверки налоговики вынесли решение о доначислении налога на прибыль 331 млн.₽ и уменьшении убытка на 1,16 млрд.₽, т.к. не было установлено оснований для извлечения доходов от данной кредитной сделки. . ‍♂️ В суде налогоплательщик пытался доказать, что на самом деле погашал кредиторку перед связанной компанией. . ‍⚖️ Но суды (первая инстанция, апелляция и кассация) не поверили ⛔️ и правильно сделали. ✔️Во-первых, документы эти "нашлись" лишь на стадии рассмотрения в суде ✔️Во-вторых, они противоречили данным учета и документам, представленным в ходе проверки ✔️ В-третьих, даже по анализу доков, предоставленных налогоплательщиком в суд, возможное превышение кредиторки над дебиторкой в 2 раза меньше суммы кредита (взятого у банка) ✔️В-четвёртых, налицо подконтрольность действий - документы подписывал один и тот же человек (ген директор налогоплательщика, директор по стратегическому развитию в связанной компании и президент в материнской). . #налоговаяпроверка #налоги #судебнаяпрактика #какделатьненадо #налоговаяоптимизация #профессионал #решениесложныхзадач #юрист #финансист #тендерныйэксперт #аудит #duediligence #бизнес #правоваяподдержка #fltnavigator
