What's happening is a #negotiation: the #debtee is #wanting a payment of 350 while Sam, the #debtor, is #negotiating for a more financially practical payment. Sam #elects to #offer 3 bucks. * Here is where it gets interesting >>> Sam is trying to tender a payment, and "[i]f tender of a payment to pay an obligation of a[ debt] to a [debtee], and the tender is refused, there is #discharge, to the extent of the amount of the tender..." UCC 3-603. So, Sam #owes 16k and is #offering to tender 3 bucks of that payment, and if the debtee refuses, then the amount tendered is discharged, so now Sam owes 15,997 for merely offering to make a payment on the debt and said offer is refused; this is why they will take this ridiculous offer of 3 bucks! * Now, what about #acceptance? This is a very fun mechanic is contract law, if you're witty. On the #LEGALDECEPTION podcast there was talk of a man who owed a debt, and this clever man drafted a money order for 1 #dollar. On the memo line of the money order he wrote "final payment" and the debtee cashed it!! The next pay period they sent him a letter saying that the man was late on his payment, and he responded with: "I do not owe you anymore. You #accepted my offer for final payment." They took him to court and the judge said in so many words - Idk what to you guys, you accepted this man's offer for final payment. The "final payment" memo was a part of the negotiation of this man's attempt to tender a payment, and IT WAS ACCEPTED!!! READER BEWARE: the UCC statute I used is a FEDERAL statute! The Uniform Commercial Code that everyone is using - ex: UCC 1-308 - is Federal law, and is officially titled the "DC Code" (read: Public Law 88-243) and therefor only has authority within DC. * READ THE CONTRACT! There will be a "choice of law" clause that will dictate which body of law has authority. If that clause says that Maine is the governing law, then you cannot use the federal UCC and will have to cite Maine's UCC.
